Solicitors

Residential solicitation is authorized by permit (PDF) only, between the hours of 9 a.m. and 6 p.m. of any day. In addition to completing the permit form, applicants must also provide written verification from the business for which they are soliciting.

Organizations on the approved list, which have acquired exempt status, and religious organizations, may solicit between the hours of 9 a.m. and 9 p.m. on any day. In order to be placed on the approved list, charitable organizations and religious institutions must be in compliance with 3-7B-8-B (PDF).

Residents who desire not to be visited by solicitors may obtain a card at the Batavia Police Department. The card reads No Solicitors Invited or Only Solicitors Registered in Batavia Invited. Solicitors shall not go upon any premise or engage in any soliciting in defiance of this notice exhibited. It shall be the duty of every solicitor, whether registered or exempt, upon going onto any premises or residence in the city to first examine the notice.

Any person violating this provision risks having their permit revoked and fined, upon conviction thereof, up to $750. Please be advised that the City of Batavia does not allow soliciting on street corners and/or in intersections.

Peddlers & Hawkers

Peddlers and hawkers shall be defined as those persons who are engaged in going through the city, from house to house, selling merchandise along a city street or otherwise, carrying their merchandise, wares or articles for sale and selling them to customers without previously having taken orders thereof. Take a look at the complete ordinance (PDF) relating to peddlers. A permit (PDF) is required and no person shall do business in the city as a peddler or hawker without having first secured a permit. In addition to completing the permit form, applicants must also provide written verification from the organization for which they are conducting business.

As with solicitors, peddlers and hawkers shall not go upon any premise or engage in any peddling or soliciting in defiance of the notice, no solicitors invited, exhibited.
