NOTICE OF PUBLIC HEARING
PUBLIC NOTICE is hereby given to all persons concerned that on the 19th day of April, 2023, at 7:00 p.m., the Plan Commission of the City of Batavia will meet and a Public Hearing will be held pursuant to Chapters 3.1, 5.2,5.7 and 5.8 of the Batavia Zoning Code to consider Amendments to the Comprehensive Plan Land Use Map and Official Zoning Map to reclassify certain property and to expand an existing Planned Development Overlay District granted by Ordinance 16-78 for the Batavia Wastewater Treatment Plant. The Plan Commission concurrently will hold an open meeting to consider Design Review, pursuant to Zoning Code Chapter 5.6.
The property that is subject of the hearing is located at 100 Flinn Street, 400 South Shumway Avenue (PIN 12-22-403-003) and a Portion of Property at 103 Main Street (12-22-403-002). The applicant is the City of Batavia, 100 North Island Avenue, Batavia IL 60510. The City and Batavia Enterprises 140 First Street, Batavia IL 60510, are owners of the property made as part of this request.
The applicant proposes to modify the Planned Development granted by Ordinance 16-78 to request a major change under the Planned Development to add an additional building to the site and make other improvements to the plant as part of the next phase of the Wastewater Treatment expansion project and includes certain modifications from the Zoning Code. These modification requests include a reduction in the Perimeter Landscape Area along Flinn Drive of 11’ 6” instead of the required 20’. A proposed fence height of 9’3” instead of the required 8’ max and placement of certain outdoor storage areas into required landscape areas by approximately 8’ 6”. Other Zoning Code modifications may be required for the proposed plan. The Planned Development Amendment would be expanded to cover a portion of 103 Main Street, which the City is contracted to purchase for the expansion. The amendment would also consider amending the Comprehensive Plan Land Use Map designation for this property from Light Industrial to Public Facilities and Institutional and amend the Zoning Map to reclassify the property from LI, Light Industrial to PFI, Public Facilities and Institutional District. Design Review is being sought for the proposed new building at Flinn Street.
