NOTICE OF PUBLIC HEARING
PUBLIC NOTICE is hereby given to all persons concerned that on the 1st day of June, 2022, at 7:00 p.m., the Plan Commission and Zoning Board of Appeals of the City of Batavia will meet and a Public Hearing will be held pursuant to Chapters 5.2 and 5.5 of the Batavia Zoning Code to consider a requested variance for building height and signage. The Plan Commission concurrently will hold an open meeting to consider Design Review, pursuant to Zoning Code Chapter 5.6.
The property that is subject of the hearing is located at 550 North Randall Road (Lot 3 of Kingsland Subdivision Unit 1), PINs 12-16-301-001, 12-16-301-002 and 12-16-301-003). The applicant is Tower Construction Company, 2093 Orchard Lake Road, Sylvan Lake, MI 48320 and the property owner is Spirit Master Funding X LLC 2727 N Harwood St Suite 300, Dallas TX 75201.
The applicant proposes variances from the City of Batavia Zoning Code: 1: From Table 2.304 to allow a building addition with a height of approximately 51.4 instead of the 45 feet required a variation of 6.4 feet and; 2. From Section 4.406.B.3.d.2 to allow 42” tall directional signs, 6.7 square feet in area rather than the 36” tall 3 square feet in area, a variation of 6” in height and 3.7 square feet in area. The variances and Design Review are for a proposed addition for a Emagine Movie Theater with Super Emax screen.
Pursuant to Governor Pritzker’s Executive Orders in effect when publication of this legal notice was requested, the Plan Commission meeting at which this advertised Public Hearing is to occur may be conducted solely virtually via electronic means. The meeting’s agenda will be posted a minimum of 72 hours before the meeting at: www.cityofbatavia.net/agendacenter and the posted agenda will provide instruction on how one may attend and participate in the virtual meeting and public hearing. Go to www.cityofbatavia.net/PC1 to register for the Zoom meeting. Should the Executive Order that authorizes virtual meetings be lifted, the meeting and hearing shall be held at City Hall 100 North Island Avenue, Batavia IL 60510. Individuals that have registered for the virtual meeting will be notified by email prior to the Hearing of the change in venue. Public comments may also be e-mailed to email@example.com prior to the meeting for entry into the hearing public record.
